Thank you for visiting Creative Network Innovations, hereafter referred to as "CNI." Your privacy is important to us, and our policy is simple: we collect no personally identifiable information about you when you visit the Web Site, excluding rudimentary IP statistics used for performance monitoring, unless you choose to provide that information. Please be aware that this Privacy Policy does not describe information collection practices on other sites, including those linked to or from the Web Site, or customer sites which CNI provides connectivity for.

Information Collection & Use

Creative Network Innovations, hereafter referred to as "CNI", is the sole owner of the information collected on www.cniweb.net. The server on which the Web Site is located collects and saves only the default information customarily logged by web server software. Such information may include the date and time of your visit, the originating IP address, and the pages and images requested. This information is typically used for diagnostic and troubleshooting purposes and/or to determine hardware loads and utilization.

Contact Forms

When you complete a contact form or submit an online trouble ticket, we request that you provide certain personally identifiable information, including your name, company, address, and phone number. This information is necessary so that we can contact you.

Upon submitting a contact form, your name and email address, and any other information you provided, may be included in our internal customer database to facilitate future service requests and to provide a record of any services provided to correct issues, etc.

Communications from the Site

If you are entered into our customer database, or are a direct customer of CNI, you may receive  notifications regarding network maintenance, critical security issues, or other information directly pertinent to the integrity of your service. If you would prefer not to receive this information, please see the "Choice/ Opt-out" section.

Information Sharing and Disclosure

We do not share personally identifiable information with Third Parties. However, non-personally identifiable information may be provided to our partners to assist with network troubleshooting or assessing network performance metrics.

Legal Disclaimer

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our company.

Choice/Opt-out

We provide you the opportunity to "opt-out" of having your personally identifiable information used for certain purposes when we ask for this information. For example, when you complete an online inquiry form you have the opportunity to opt-out of receiving any future notifications.

If you wish to be excluded from all future communication, excluding mandatory billing issues or legal mandates, you may do so by emailing us at support@cniweb.net and specifically stating that you wish to opt out of all communication and have your personal information removed from out databases. Log Files

As is true of most Web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users' movements around the site and to gather demographic information about our user base as a whole.
Any cookies or session values stored on your browser are used exclusively for the purpose of maintaining your browser session with our website, and are not related to any marketing use.

Physical Security

CNI facilities are based in Tier3 and Tier4 data centers, utilizing multiple perimeters of security, highly restricted access and an escort-only policy. Full video logging is maintained of entry and egress, with each visitor required to sign in, provide picture ID, and be documented on video providing this information. Visitors on site are made aware of these requirements and that such data is stored for the sole purpose of verifying access and identity information.

All information stored on customers is kept in a highly secured database not accessible from outside CNI's internal network.

Testimonials

Occasionally, CNI may post customer testimonials on our web site or in print advertising which may contain personally identifiable information such as the customer's name. In these circumstances, we obtain the customer's consent prior to posting the testimonial to post their name along with their testimonial.

Links to Other Sites

Our Web site and the content therein, such as Security Alerts, may contain links to other sites that are not owned or controlled by CNI. Please be aware that CNI is not responsible for the privacy practices of such other sites. We encourage you read the privacy statements of sites that are linked to ours.

Access to Personally Identifiable Information

Because this web site wants to demonstrate its commitment to your privacy, it has agreed to disclose its information practices and is a willing participant in the EU Safe Harbor framework. as set forth by the Department of Commerce regarding the collection, use, and retention of data from the European Union.

If you have any questions or concerns related to Safe Harbor, CNI will respond to your request to access or delete personal information within 30 days as is required under the EU Safe Harbor program.

CREATIVE NETWORK INNOVATIONS SAFE HARBOR POLICY FOR EUROPEAN UNION EMPLOYEES PERSONAL DATA

Introduction

CREATIVE NETWORK INNOVATIONS and its affiliates (CREATIVE NETWORK INNOVATIONS) have a need to compile and extract human resources data which includes data concerning its employees in the European Union (EU). This Safe Harbor Policy has been adopted consistent with the Safe Harbor Principles of the US Department of Commerce and the EU Directive on Data Protection.

This policy applies to all human resources data transmissions received from CREATIVE NETWORK INNOVATIONS operations in EU countries, including electronic, telephonic, and written transmission.

Human Resource Data is any human resource information relating to an identified or identifiable natural person who is an CREATIVE NETWORK INNOVATIONS employee and who can be identified, directly or indirectly, in particular by a reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity.

Responsibilities

In implementing this policy, CREATIVE NETWORK INNOVATIONS will annually self-certify to the Department of Commerce, that it agrees to adhere to the Safe Harbor Principles.

CREATIVE NETWORK INNOVATIONS acknowledges that its failure to provide an annual self-certification to the Department of Commerce will result in the removal of CREATIVE NETWORK INNOVATIONS from the list of participants.

Questions regarding the transmission of human resource data from the EU to the United States or any other non-EU location, or any further transmission of the personnel data once received in the United States, should be referred to John Cowan, who is responsible for maintaining this document.

Guidelines

The Safe Harbor Principles to which CREATIVE NETWORK INNOVATIONS will adhere are notice, choice, transfer to agent third parties, access, security, data integrity and enforcement.

Notice: CREATIVE NETWORK INNOVATIONS will collect and use human resource data for the purposes of global enterprise headcount reporting, statistical analysis, compensation planning and related transactions, career development, staffing, international personal security issues, internal investigations, ethics investigations, law enforcement inquiries, U.S. Government agency inquiries and mergers, acquisitions and divestitures. CREATIVE NETWORK INNOVATIONS recognizes that the data it receives will remain subject to any conditions or restrictions imposed by the law of the EU country in which it was collected. Employees can contact John Cowan with inquiries or complaints regarding the use of their human resource data.

Choice: (a)Opt-Out Rights. Employees will be offered the opportunity to choose (opt-out) if their data is to be (i) disclosed to a Non-Agent Third Party, as defined below, or (ii) used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the employee. In certain limited circumstances, in accordance with Safe Harbor Principles, CREATIVE NETWORK INNOVATIONS may disclose data without notice or consent (e.g. when the life or health of the employee is at stake). A Non-Agent Third Party is a party (a) who is not performing a task on behalf of or under the instructions of CREATIVE NETWORK INNOVATIONS and (b) with whom CREATIVE NETWORK INNOVATIONS has not contracted to provide at least the same level of privacy protection called for under the Safe Harbor Principles or required the third party to subscribe to the Safe Harbor Principles or otherwise be subject to the EU Directive or other adequacy filing.

(b)Opt-In Requirement. Except as allowed under the Safe Harbor Principles or applicable law, in cases implicating race, ethnic origin, political opinion, religious or philosophical beliefs, trade union membership and income records, health, sexual orientation, or alleged commission of a criminal offense, CREATIVE NETWORK INNOVATIONS will seek affirmative permission (opt-in) from the employee before it discloses data to any third party or uses data for a purpose other than those for which it was originally collected or subsequently authorized.

Transfer to Agent Third Parties: Prior to disclosing human resource data to a third party that is acting as an agent of CREATIVE NETWORK INNOVATIONS and under its instructions, CREATIVE NETWORK INNOVATIONS will either enter into a written agreement requiring the third party to provide at least the same level of privacy protection called for under the Safe Harbor Principles or require the third party to subscribe to the Safe Harbor Principles or otherwise be subject to the EU Directive or other adequacy finding.

Access: Employees covered under this policy will have access to their personnel information which CREATIVE NETWORK INNOVATIONS holds and will be able to correct, amend or delete information if it is inaccurate, unless the burden or expense of providing access would be disproportionate to the risks of the individual privacy in the case in question or the rights of persons other than the individual would be violated. Requests to review information should be made to John Cowan.

Security: In order to protect personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction, CREATIVE NETWORK INNOVATIONS has implemented procedures and protections designed to ensure the confidentiality and integrity of human resource data. These measures include segregation of the server housing employee data, strictly controlled access requiring approval from executive HR management, and individual password security. Additionally, only the HR personnel will have access to human resource data. Regional HR Coordinators will only have access to view and maintain human resource data within their region (Asia-Pacific, Americas, and Europe).

Data Integrity: Human resource data will be collected only if relevant for the purposes for which it is to be used. CREATIVE NETWORK INNOVATIONS will take reasonable steps to ensure that the data is reliable and that it is accessed only for permissible uses.

Enforcement and Dispute Resolution: John Cowan will be the internal mechanism for ensuring compliance with the Safe Harbor Principles. To ensure compliance, CREATIVE NETWORK INNOVATIONS will:

(a)Cooperate with the European Union's Data Protection Authorities (DPAs) in the investigations of and resolution of complaints brought under the Safe Harbor Principles; and

(b)Comply with any advice given by the DPAs, including remedial or compensatory measures for the benefit of individuals affected by any non-compliance with the Principles of CREATIVE NETWORK INNOVATIONS, and will provide the DPAs with notice that such action has been taken; and

(c)Employ an annual procedure for verifying that the company has adhered to its commitment to implement the Safe Harbor Principles, verified by the testimony and signature of at least one of CREATIVE NETWORK INNOVATIONS's corporate officers.

CREATIVE NETWORK INNOVATIONS Safe Harbor Policy Changes: This policy may be amended at any time and from time to time by CREATIVE NETWORK INNOVATIONS consistent with the requirements of the Safe Harbor Principles.
